Terms and Conditions

General Terms and Conditions (GTC) of AYOS Coffee GmbH

1. Scope
These terms and conditions apply to all contracts between AYOS Coffee GmbH (hereinafter referred to as "Seller") and its customers (hereinafter referred to as "Customer") regarding the use of the online shop and the sale of goods. The offer is exclusively directed at persons residing or domiciled in Switzerland. Shipping is only available to addresses in Switzerland.

2. Contracting parties

3. Conclusion of the contract
a. The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.
b. By clicking the "Order with obligation to pay" button, the customer submits a binding order for the goods in the shopping cart.
c. The seller will confirm receipt of the order immediately by email. This order confirmation does not constitute acceptance of the offer, but merely informs the customer that the order has been received.
d. The contract only comes into effect when the seller accepts the customer's order by sending a separate order confirmation via email or dispatches the goods.

4. Prices and Payment Terms
a. The prices quoted are in Swiss francs (CHF) and include statutory VAT.
b. Shipping costs are not included in the displayed product price. They will be clearly communicated to the customer before the order is placed.
c. The customer can make payment by credit card, PayPal, Google Pay or Apple Pay.
d. Payment of the purchase price is due immediately upon conclusion of the contract.

**5. Delivery and Shipping Costs**
a. Delivery will be made to the delivery address specified by the customer.
b. The shipping costs are to be borne by the customer and are shown separately during the ordering process.
c. Delivery time is usually 1-2 days from receipt of payment.

6. Right of withdrawal
The customer has a statutory right of withdrawal. Details regarding this right are contained in the seller's cancellation policy, which is provided to the customer during the ordering process and in the order confirmation.

7. Warranty and Liability
a. The warranty is governed by the statutory provisions.
b. The seller is not liable for damages caused by improper use or handling of the delivered goods.
c. Liability for slightly negligent breaches of duty is excluded, unless these breaches concern essential contractual obligations, damages resulting from injury to life, body or health, or guarantees.

8. Data protection
The seller's privacy policy can be viewed on the online shop's website.

9. Final Provisions
a. The law of the Swiss Confederation applies, excluding the UN Convention on Contracts for the International Sale of Goods.
b. The place of jurisdiction for all disputes arising from this contract is the seller's place of business, provided the customer is a merchant or has no general place of jurisdiction in Switzerland.
c. Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
